Adjustment of status is the process that allows an eligible person to obtain permanent residence (Green Card) without leaving the United States, by changing their current immigration status to lawful permanent resident. It is an alternative to consular processing in the country of origin.
You may apply if you have an approved petition with a visa available, entered the country legally, and have no grounds of inadmissibility that cannot be waived. Immediate relatives of U.S. citizens have additional advantages, as visas are always immediately available for them.
Form I-485 is the primary form. It can be filed together with Form I-765 (work permit) and I-131 (travel document) at no additional charge. This allows you to work and travel legally while waiting for your green card approval.
Processing time varies by USCIS office and visa category. For immediate relatives of U.S. citizens, it currently takes between 12 and 24 months. During that time you will receive a work permit and travel document, allowing you to continue your normal life.
It depends on the length of the unlawful presence and how you entered. In many cases it is possible to concurrently file a waiver (Form I-601). An attorney can evaluate whether you qualify for adjustment despite prior irregularities, as each case is unique.
